1. What you can buy
| Option | Price | What you get |
|---|---|---|
| Build | A$1,499 one-off | Website build (about 6 pages), form, click-to-call, map, basic SEO, Google Business Profile basics, copy tidy-up, gallery/reviews, one simple integration, two revision rounds on the preview. Hosting/care not included unless you add care. |
| Monthly | A$199 / month | Same build, plus hosting, SSL, monitoring, updates, backups, and up to 30 minutes of small edits per month. $0 setup. |
| Care (after a Build) | A$79 / month | Optional hosting + care (same ongoing inclusions as Monthly’s care). Cancel with 30 days’ notice; no minimum. |
| Extra edits | A$90 / hour | Work beyond included edit time, quoted before we start. |
Build payments: A$749.50 deposit at checkout to start · A$749.50 final invoice before go-live DNS.
Monthly payments: first month charged at checkout; then billed monthly in advance.
Not included (unless we agree in writing): domain registration fees, email hosting, full custom copywriting beyond tidy-up / AI draft from your brief, photography, logo design, paid ads, online shops, or third-party software fees.
2. Intake and the 48-hour turnaround
After payment we email you an intake brief. The 48-hour clock starts when your intake is complete, and runs in calendar hours (not business days).
Complete intake means you have submitted, through our intake form: business name and contact details; services; service areas; a short “about”; trading hours; logo and/or photos (or written OK to use stock photos); and any must-have colours or links (e.g. booking). Incomplete or placeholder answers do not start the clock.
Within 48 hours of complete intake we aim to email you a preview link for approval (one round of changes included).
If we miss that 48-hour preview deadline: for Monthly, we credit you one free month (one A$199 month); for Build, we refund A$79. That is your remedy for a missed preview SLA. It does not apply if the delay was caused by incomplete intake, waiting on your feedback, or events outside our reasonable control. (Credits/refunds are applied when due; this clause documents the promise only.)
3. Your domain and DNS
You buy and own your domain. We do not purchase domains for you.
We send the exact DNS records for your domain only when:
- Build: after the final A$749.50 is paid (and the preview is approved); or
- Monthly: after the first month is paid and you have approved the preview.
Until then the site stays on a preview URL. You must apply the DNS changes at your registrar. We help with instructions; we are not responsible for registrar delays or mistakes on your account.
4. Monthly plan — term, buyout, handover
- Minimum term: 12 months from the start of the subscription.
- Early exit: pay a A$999 buyout (one-off) for codebase handover and to end monthly billing, or settle the remaining months of the minimum term.
- After 12 months paid: cancel with 30 days’ written notice. On cancel after the minimum term, handover of the site files is included (you own that work product). Your domain remains yours.
- If you cancel without buyout/handover and stop hosting with us, the managed site is taken down; the domain stays yours.
5. Failed payments
If a Monthly or Care payment fails, Stripe’s usual reminders apply. We may pause (take offline) your managed site 14 days after the last failed payment retry. The site can go live again once arrears are cleared, subject to these terms. Pausing does not cancel amounts already owed.
6. Content, AI copy and photos
We may prepare AI-assisted copy from your intake and use stock photos where you have not supplied suitable images. Drafts go to you for approval before go-live.
You are responsible for all content you supply or approve (including claims about your business, licences, prices and images). You confirm you have the rights to use that content and that it is lawful. You must not ask us to publish anything illegal, misleading or infringing.
7. Ownership
- Build: once the final payment is received, you own the website we built for you (excluding our tools, templates and third-party components).
- Monthly: during the term we host and manage the site for you; ownership of the customised site files passes on buyout or on handover after the minimum term as in section 4.
- Our branding, templates, automation and software stay ours. Third-party services (e.g. hosting, fonts, stock libraries) keep their own terms.
8. Changes and termination
We may update these terms with notice on heapsbusy.com.au or by email; changes apply to new orders and renewals. Material changes during a paid Monthly term will not reduce the package you already bought for that term without your agreement, except where the law requires.
We may suspend or end service for serious breach, unlawful use, or non-payment (see section 5). You may end as set out in sections 1 and 4. Sections that should survive (including liability, privacy references and ownership) continue after termination.
9. Privacy
We collect and use personal information to take orders, build and host your site, bill you and contact you about the service. We handle personal information in line with our Privacy Policy at heapsbusy.com.au/privacy (or the current URL we publish) and the Privacy Act 1988 (Cth) where it applies. Contact us to access or correct your details.
10. Liability and Australian Consumer Law
To the extent permitted by law, our total liability to you for all claims arising out of or in connection with these terms or the services is limited to the fees you paid us in the 12 months before the claim.
We are not liable for indirect or consequential loss (including lost profits or lost business), or for delays caused by you, your registrar, third-party platforms, or events outside our reasonable control.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (or any other law) that cannot be excluded. Where we are allowed to limit remedies for a failure to comply with a non-excludable guarantee in relation to services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to supplying the services again or paying the cost of having them supplied again.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. Courts of NSW (and any courts that hear appeals from them) have jurisdiction.
